Dred Scott HISTORY
-African American slave living in Missouri.
-slave of John Emerson who lived in Missouri, but over a few years, moved to Illinois, and Wisconsin Territory, (free region/state)
-moved back to Missouri.
-Scott sued for his freedom in a Missouri court
Dred Scott ARGUE AND DECISION
-His argue was that when Dr. Emerson took him to Wisconsin Territory and Illinois, he was free, and just because he came back, didn’t mean he could be re-enslaved
-other side argued that the majority of “The Negro Race”, were not considered as citizens by the constitution of the U.S.
-because he wasn’t a citizen, he wasn’t able to bring his case in front of a court. (Bill of Rights, 5th amendment says that slaves are property)
-They also ruled that living in Illinois or the Wisconsin Territory, didn’t make him free because the Missouri Compromise, which had banned slavery had in that territory had be unconstitutional.
Dred Scott IMPACT/AMENDMENTS
-Because of this decision slavery went on
-Because slaves were property, and property was protected by the 5th amendment in the Bill of Rights, Congress had no legal authority to deprive citizens of their property, including slaves, anywhere within the United States.
-For the future, Congress can not pass laws limiting slavery in the western territories.
-USED THE 5TH AMENDMENT
Plessy V. Ferguson HISTORY
-Homer Plessy was arrested for taking a seat on a railroad car, reserved by Louisiana law for white people
-Plessy took this to court arguing the law under which he was arrested was unconstitutional
Plessy V Fergson ARGUE AND DECISION
-Plessy took this to court arguing the law under which he was arrested was unconstitutional
-the court ruled against him saying that the railroad provided separate but equally good cars for the African American passengers.
